The court ruled that the Hisbah Commission does not have the authority to arrest Murja Ibrahim Kunya.
The High Court of Kano State, presided over by Judge Nasir Saminu, addressed the case brought by Kunya against the Hisbah Commission, the Kano Police Commissioner, Dawanau Hospital, and a judge from the Fourth Islamic Law Court. Judge Saminu stated that the Hisbah Board has no legal power to arrest, investigate, or prosecute individuals in court. He emphasized that while the Hisbah’s role involves preaching, any attempts to arrest individuals in this context are illegal.
The court dismissed the prosecution of Kunya in the Four-Day Court, citing legal violations. Additionally, Judge Saminu ordered that Murja Kunya’s phone and ATM card be returned to her immediately.
The court also mandated that Kunya pay two hundred thousand naira each to the police and Dawanau Hospital due to her failure to present her case against them in court. Furthermore, the judge instructed the Commissioner of Police to arrest Murja Kunya if she engaged in any activities deemed contrary to religion and culture.
